CLE: Successfully Navigating Parallel Proceedings
Ricardo Solano presented on a panel addressing the management of parallel and civil proceedings at the 2017 Hispanic Bar Association Annual Convention, held from September 6-9 in Kansas City, MO.
In various areas of criminal law, including, for example, False Claims Act, FCPA, FDA, and securities cases, the government often commences a civil or regulatory case or investigation to run concurrent with an ongoing criminal investigation. Even when it does not, a government criminal investigation in these areas may lead to private civil lawsuits. Attorneys that represent companies and individuals facing such a situation must carefully balance the at-times competing interests of the client in the different forums and avoid potential pitfalls, such as inadvertently waiving a privilege by the actions taken in one proceeding.
Mr. Solano's panel discussed strategies for successfully navigating parallel proceedings, handling discovery issues, protecting client privileges, and opportunities for using the different proceedings to the client's advantage. The session took place on Friday, September 8 from 2:15-3:30 PM ("Successfully Navigating Parallel Proceedings").
